Abbe Lowell News

As criticism grows, Hunter Biden’s attorney claims that a trial is not inevitable.

A trial is “not inevitable,” according to Hunter Biden’s attorney, who made the statement on Sunday, days after the Trump-appointed US attorney who is looking into the president’s son was given special counsel status after failed plea negotiations to resolve tax and gun charges.

“The prosecutors who came forward to us and we were the ones to ask: ‘Can there be a resolution short of a prosecution?’ were both attempting to avoid one all along. Therefore, they wanted it and may still desire it, Biden’s attorney Abbe Lowell said on CBS’ “Face the Nation.”

Attorney General Merrick Garland appointed David Weiss as a special counsel, giving him more authority than a typical US attorney and more independence from the Justice Department as he prepares to conduct an unprecedented trial against the president’s son and amid Republican claims that the department is politicized.

When a plea agreement was announced in June, it seemed as though the investigation was over. Hunter Biden had made a deal with the government in which, if he kept out of problems with the law and passed drug tests, the prosecution would dismiss a second felony gun case in two years in exchange for his guilty plea to two tax-related misdemeanors.

The agreement, however, was severely criticized in court last month by the federal judge presiding over the case.

On Sunday, Lowell praised Hunter Biden’s defense team and blamed the failure of the accord on federal prosecutors. What team of seasoned defense attorneys would permit their client to enter a misdemeanor guilty plea on a Monday knowing that a felony charge could be filed on Wednesday? That wouldn’t take place, he assured.

According to Lowell, President Joe Biden is “nothing but a loving father” and there is “no evidence” to charge the president for his son’s alleged offenses.

However, House Speaker Kevin McCarthy and other prominent Republicans on Capitol Hill criticized Garland’s choice to designate Weiss as a special counsel and threatened to pursue their own inquiries.

On “State of the Union” on CNN on Sunday, Democratic Oversight Committee member and New York Representative Dan Goldman said that if Hunter Biden had committed any crimes, he should be held accountable. I’m saying that as a Democrat.

“You won’t hear any Republican who is now in office advocating for Donald Trump to be prosecuted with and punished for any crimes he may have done. And that’s an important distinction that the general people need to be aware of, he continued.

“And here is again another example of how truly independent this Justice Department is. The president’s son is under investigation by a U.S. attorney that Trump selected. That is just amazing. Additionally, you don’t hear any respect from the opposing side for Joe Biden’s decision to stay out of this probe, according to Goldman.

Former Texas congressman and current Republican presidential candidate Will Hurd told Tapper in a separate interview for “State of the Union” that “the immediate family of a president should not be allowed to be lobbyists or consultants when their father or their husband is the President of the United States.”
