Katelyn Polantz News
According to CNN correspondent Katelyn Polantz, Federal District Judge Tanya Chutkan wasted little time in responding to the former president’s remarks on the lawsuit at a hearing on Friday.
Trump is facing a grand jury indictment for attempting to rig the 2020 presidential election before and on January 6, 2021, and Judge Chutkan is presiding over his trial. Trump is accused of conspiring to defraud the United States, obstructing official business, trying to hinder an official business, and conspiring against rights.
The protective order that Smith’s team is requesting was the subject of a tense hearing on Friday’s CNN News Central, and anchor John Berman threw to Polantz for the first of likely many up-to-the-minute updates. According to Polantz, the judge got right to the point concerning Trump’s “free speech”:
JAMES BERMAN Really, only ten or fifteen minutes have passed since the hearing started. Already, we are learning some extremely intriguing details about how Judge Chutkan will proceed with this case as well as some clear indications of where things are going. For these tidbits, let’s jump right to Katelyn Polantz. Katelyn, the judge is not really wasting any time here.
Katie Panitz: Very little time. This session is only 20 minutes old, and already we are discussing Donald Trump’s speech outside the courtroom. And I want to relay a comment the judge just made while she was sitting at the bench debating if she could issue some sort of overlay order telling him he can’t divulge material he learns during this pretrial preparation as his team is getting ready.
According to her, Mr. Trump has the same First Amendment right to free expression as every other American, but this freedom is not unqualified. The rules apply to the defendant’s free speech in a criminal defendant’s case like this one.
And today in court, Judge Chutkan is already signaling that she is prepared to rule and decide how this matter will proceed. Additionally, a Justice Department lawyer once told her that they thought Trump wanted to have this issue tried in the media before the trial. She also made it clear that she intends to talk about it at the hearing today. She also mentions that she wants to make sure that the safety of witnesses is taken into account while making decisions.
Therefore, there may be certain restrictions on what Trump can say about the evidence he learns through witness testimony that may have been given against him or about him in grand jury hearings. He would also likely learn about other information from witness testimony that has already been given. She has also stated that she does think such an order is necessary because it is a judicial matter, not a political one, and the jury pool needs to be protected. Because Donald Trump is a criminal defendant in this case and deserves a fair trial, that jury pool shouldn’t be polluted.
